Terms and Conditions

Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

  • Cooling-off period: The period during which the consumer may exercise their right of withdrawal;
  • Consumer: A natural person who does not act in the course of a trade, business, or profession and enters into a contract with the entrepreneur remotely;
  • Entrepreneur: The legal entity or individual offering products and/or services remotely to consumers;
  • Distance contract: A contract concluded remotely between the entrepreneur and the consumer, using an organised system for remote sales;
  • Right of withdrawal: The consumer's right to cancel the contract within the cooling-off period;
  • Durable medium: Any instrument that enables the consumer or entrepreneur to store information so it can be retrieved and reproduced unchanged in the future;
  • Terms and Conditions: These General Terms and Conditions of the entrepreneur.

Article 3 – Applicability

  1. These Terms and Conditions apply to every offer made by the entrepreneur and every contract concluded between the entrepreneur and the consumer.
  2. Before the contract is concluded, the consumer will be provided with a copy of these Terms and Conditions.
  3. If the contract is concluded electronically, the Terms and Conditions will be available for download.
  4. Any situations not covered by these Terms and Conditions will be assessed in line with the spirit of these conditions.

Article 4 – The Offer

  1. All offers are non-binding, and the entrepreneur reserves the right to modify or withdraw offers.
  2. Product images and descriptions are indicative and may slightly differ from the actual product.
  3. The entrepreneur is not bound by any obvious errors or misprints in the offer.

Article 5 – The Contract

  1. The contract comes into effect when the consumer accepts the offer and fulfils the stipulated conditions.
  2. The entrepreneur will confirm acceptance via email.
  3. If the entrepreneur cannot fulfil an order, the consumer is entitled to a full refund.
  4. The entrepreneur takes appropriate technical and organisational security measures for electronic transactions.

Article 6 – Right of Withdrawal

  1. The consumer may withdraw from the contract within 14 days without providing a reason.
  2. During this period, the consumer must handle the product and packaging with care.
  3. The consumer must return the product within 14 days of withdrawal, bearing the shipping costs.

Article 7 – Costs in Case of Withdrawal

  1. The consumer is responsible for the return shipping costs.
  2. The entrepreneur will refund the purchase price within 14 days of receiving the returned product.

Article 8 – Exclusion of Right of Withdrawal

  1. The right of withdrawal does not apply to:
    • Custom-made products based on consumer specifications;
    • Sealed hygiene products that have been unsealed.
  2. Exclusion is only valid if clearly stated in the product offer.

Article 9 – Pricing

  1. All prices include VAT.

Article 10 – Warranty and Conformity

  1. The entrepreneur guarantees that products comply with the contract and legal standards of quality.
  2. Any defects or incorrect deliveries must be reported within 14 days of receipt.
  3. The warranty is void if:
    • The product is misused or improperly installed;
    • The damage is caused by external factors such as lightning, water, or power surges;
    • Repairs or modifications are made by third parties.

Article 11 – Delivery and Execution

  1. The entrepreneur aims to deliver orders within 30 days, unless otherwise agreed.
  2. The risk of loss or damage transfers to the consumer upon delivery.

Article 12 – Liability

  1. The entrepreneur is not liable for:
    • Damage resulting from incorrect use or installation of the product;
    • Damage caused by external factors (e.g. power surges, lightning, water damage);
    • Modifications or repairs carried out by the consumer or third parties;
    • Indirect or consequential losses, such as loss of revenue due to a defective product.
  2. The entrepreneur’s total liability is limited to the purchase price of the product.
  3. The consumer is responsible for correctly installing and using the product according to the manual.
  4. The entrepreneur is not liable for any damage caused by a defective product, unless gross negligence or intent is proven.
  5. If a product causes a fire due to a manufacturing defect, the entrepreneur may refer liability to the manufacturer’s product liability insurance.

Article 13 – Payment

  1. Payments must be completed within 7 days of purchase.
  2. In case of non-payment, the entrepreneur may transfer the debt to a collection agency.

Article 14 – Complaints Procedure

  1. Complaints must be submitted in writing within 7 days after the issue has been discovered.
  2. The entrepreneur will respond to complaints within 14 days.
  3. If no resolution is reached, the complaint can be submitted to an independent dispute resolution body.

Article 15 – Dispute Resolution

  1. All contracts between the entrepreneur and the consumer are governed by UK law.
  2. Any disputes will be resolved in UK courts.

Article 16 – Force Majeure

  1. The entrepreneur is not liable for delays or damages caused by force majeure, including war, pandemics, natural disasters, strikes, or technical failures.

Article 17 – External Applications

  1. Some products require an external application that is not managed by the entrepreneur.
  2. Any additional costs for app usage are payable to the app developer.
  3. The entrepreneur is not responsible for updates, outages, or changes to the app.

Article 18 – Final Provisions

  1. By placing an order with Beldeur.co.uk, the consumer automatically agrees to these Terms and Conditions.
